If you park your car on a bike lane, you shouldn’t rely on it being there when you come back. Even if others park incorrectly.
A.Cars that are only partially parked on cycle paths may also be towed away. This applies, for example, if other owners commit the illegal behavior the wrongdoer could imitate. The Higher Administrative Court of Munster has recorded this in a decision (Az .: 5 A 954/10), as the ADAC announced in Munich.
In that case, a driver partially parked his car on a cycle path during a major event. The court ruled that the towing was legal at the owner’s expense – although his car protruded less than other vehicles into the cycle path and no specific danger to other road users depicted.
According to the court, there was a risk that other motorists would follow a bad example.
According to ADAC, the principles of the decision also apply to sidewalk parkers. The automobile club would like to point out that vehicles may only be parked there within the markings. In addition to the high towing costs, parking offenders must expect a fine of at least 15 euros.
